Tree Sale Purchase Agreement & Care Policy

2026-2027 Season

Nashville Tree Conservation Corps ("NTCC")

By purchasing a tree, planting service, or related item through the NTCC Tree Sale (the "Program"), you ("Buyer" or "Homeowner") agree to the following terms.

1. Order Fulfillment & Delivery Window

Orders are typically fulfilled within 30-45 days of purchase. This is an estimated timeframe, not a guaranteed delivery date; actual timing may vary due to weather, tree availability, seasonal volume, or vendor scheduling.

If your order has not been fulfilled within 60 days of purchase, contact help@treeconservationcorps.org for a status update. If NTCC cannot complete fulfillment within a reasonable additional timeframe, you may request a full refund or store credit for that order.

2. Additional Orders & Batching

Tree orders are typically batched within 7-14 day windows of delivery. Additional trees ordered within the batched window of an initial purchase will be included in the same fulfillment window as the original order.

Trees ordered after this 14-day window will be treated as a new order, with its own fulfillment window beginning on the date of that order.

3. Placement Instructions & Property Access

Special instructions regarding tree placement must be included at the time of order, or communicated by email to help@treeconservationcorps.org at least 24 hours before scheduled planting.

If the designated planting location is inaccessible during business hours at the time of delivery or planting (e.g., impeded by locked gate, fenced area, object, etc.), the crew will leave the tree in the front yard, and any planting fees will be refunded.

4. Planting Service, Flag Placement & Utility Marking

If you purchased the tree-planting service, you will receive a letter by mail from NTCC with a flag and instructions.

Please place the flag(s) at the exact location(s) where you would like your tree(s) planted before the planting crew arrives.

NTCC will arrange for 811 utility marking so underground public utility lines are identified prior to planting. NTCC is not responsible for damage to unmarked private lines (e.g., irrigation systems, invisible pet fencing, low-voltage lighting) that fall outside the public 811 marking process.

You are not required to be home during planting, provided the flag(s) are in place and the site is accessible.

5. Tree Health, Care Responsibility & Limited Guarantee

NTCC cannot guarantee that your tree will survive after planting. Tree health depends primarily on regular watering and care by the homeowner, which is outside NTCC's control once planting is complete. This is not time-limited — it applies from the date of planting onward.

Separately, installation concerns (e.g., incorrect planting location, planting depth, staking, or a damaged or incorrect tree at delivery) should be reported to help@treeconservationcorps.org within 30 days of your planting date. NTCC will address valid installation concerns raised within this window at no additional cost.

The 30-day window in this section applies only to how the tree was installed. It does not extend, shorten, or otherwise apply to the tree's ongoing health or survival, which is addressed separately above and is never guaranteed.

Homeowners are responsible for regular watering (particularly during the tree's first year), mulching, and protecting the tree from damage (e.g., lawn equipment, herbicide drift, pets, foot traffic).

6. Refunds & Cancellations

Orders may be cancelled and refunded in full before delivery or planting has begun as long as NTCC is notified during normal business hours.

Once delivery or planting has begun for a given order, that order is final and non-refundable, except as provided in Section 1 (delayed fulfillment).

7. Species Availability & Substitution

Tree species availability is subject to nursery supply. If your selected species becomes unavailable, NTCC will contact you to offer a comparable substitute species or a full refund for that item.

8. Photos & Promotional Use

NTCC may photograph or record trees, plantings, and yards as part of the planting process for use in promotional materials, social media, and reporting to funders. If you would prefer that your property not be included, let us know at help@treeconservationcorps.org and we will honor your request.

9. General Terms

This agreement is governed by the laws of the State of Tennessee.

If any provision of this agreement is found unenforceable, the remaining provisions remain in effect.
